General Terms and Conditions

These terms and conditions (hereinafter referred to as "the Terms and Conditions") define the rights and obligations of Glow Mark and its clients with regard to the services offered. By accessing our services, you unconditionally accept these Terms and Conditions.

1. Introduction to Glow Mark Agency

Glow Mark Agency is a company specializing in digital marketing services, including SEO optimization, content creation, advertising campaign management, and web audits.

2. Purpose of the Services

Glow Mark Agency offers the following services:

  • •Search engine optimization (SEO)
  • •Creation and optimization of textual and digital content
  • •Management of online advertising campaigns
  • •Web performance audits and analyses

Details of the services are specified in the quotes or contracts specific to each client.

3. Quotes and Orders

  • •Quotes: Quotes are valid for a period of 30 days from their date of issue.
  • •Validation: Any order is considered accepted after written validation (signature or agreement by email) of the quote by the client.
  • •Commitment: Once validated, the order commits the client and Glow Mark Agency to the defined services.

4. Prices and Payments

  • •Prices: Prices are expressed in euros and excluding taxes (HT), unless otherwise stated.
  • •Payment: Payments are due according to the terms indicated on the quote or invoice (single payment, monthly, or other).
  • •Late payment: In case of delay, penalties at the legal rate will apply, as well as a fixed compensation for recovery costs of €40.
  • •Suspension of services: In case of non-payment, Glow Mark Agency reserves the right to suspend services until payment is received.

5. Obligations of Glow Mark Agency

Glow Mark Agency is committed to:

  • •Provide services diligently and professionally
  • •Inform the client of the progress of the projects
  • •Protect confidential data provided by the client

Glow Mark Agency is bound by an obligation of means, and not of result, particularly in terms of SEO and SEO performance, as these depend on many external factors.

6. Client Obligations

The client agrees to:

  • •Provide complete, accurate and up-to-date information necessary for the performance of services
  • •Actively collaborate with Glow Mark Agency by responding to information requests within agreed deadlines
  • •Respect payment deadlines

7. Intellectual Property

  • •The content, tools and methodologies developed by Glow Mark Agency remain the exclusive property of the agency, unless otherwise specified in the contract
  • •The client has the right to use the deliverables within the scope of their professional activity, subject to full payment for the services

8. Confidentiality

Glow Mark Agency and the client agree to maintain the confidentiality of information exchanged during the course of services. No information will be disclosed to third parties without prior consent, except where legally required.

9. Limitation of Liability

  • •Glow Mark Agency cannot be held responsible for indirect damages (loss of revenue, loss of data, etc.) related to the use of its services
  • •In the event of a dispute, Glow Mark Agency's liability is limited to the total amount of services invoiced over the last 3 months

10. Termination

  • •The customer may terminate a contract by respecting a 4-week notice period notified in writing
  • •Glow Mark Agency may terminate a contract in the event of serious breach by the client (non-payment, non-cooperation, etc.), after a formal notice has gone unanswered

11. Force Majeure

Glow Mark Agency cannot be held responsible for any delay or failure to perform resulting from a case of force majeure (natural disasters, cyberattacks, strikes, etc.)

12. Claims and Disputes

  • •All complaints must be addressed in writing to: Glow Mark srl / bv, Merksemsesteenweg 112, 2100 Antwerpen, or by email to info@glowmarkagency.be
  • •In the event of a dispute, the parties will endeavor to find an amicable solution. Failing that, the competent courts of Antwerp shall have sole jurisdiction to decide the matter

13. Applicable Law

These general terms and conditions are governed by Belgiun law.
